1. Acceptance of Terms
By accessing or using AIVideo AI (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use this Service. By using the Service, you represent and warrant that you meet this age requirement. We reserve the right to request proof of age at any time and to terminate accounts that do not meet this requirement.
3. Account Registration
To access certain features of the Service, you may need to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Upload, process, or distribute any content depicting minors in any context.
- Upload images of real individuals without their explicit, informed consent.
- Use the Service to create content for purposes of harassment, blackmail, extortion, or defamation.
- Use images of celebrities, public figures, or any person without their authorization.
- Use the Service to infringe upon any person’s intellectual property rights, privacy rights, or publicity rights.
- Attempt to reverse-engineer, decompile, or extract the source code of our AI models or algorithms.
- Use automated tools, bots, or scripts to access the Service beyond normal usage.
- Resell, redistribute, or sublicense access to the Service without our written permission.
5. Content and Intellectual Property
All AI-generated output created through the Service is provided to you for personal use. You retain rights to the output generated from images you have lawfully uploaded. However, you are solely responsible for ensuring that your use of such output complies with all applicable laws.
The Service itself, including its design, code, AI models, trademarks, and all related intellectual property, remains the exclusive property of AIVideo AI.
6. Payment and Credits
Certain features of the Service require the purchase of credits. All purchases are final and non-refundable except as described in our Refund Policy. Prices are subject to change with reasonable notice. Credits have no cash value and cannot be transferred to other accounts.
7. Data Handling
Uploaded images and generated results are temporarily stored on our servers for processing purposes and are periodically deleted. We strongly recommend that you download your results promptly. For full details on how we handle your data, please see our Privacy Policy.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIVIDEO AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify, defend, and hold harmless AIVideo AI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination, your right to use the Service will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be resolved through good-faith negotiation, and if necessary, binding arbitration.
